PRIVACY POLICY
This privacy policy (this “Policy”) describes the privacy practices of Authentix, Inc., its subsidiaries and affiliates (“Company”), and applies to this Authentix® website (the “Website”) and all services offered by or through the Website (the Website and such services are collectively the “Services”). This Policy further incorporates the EU/GDPR Policy for personal data of individuals as set forth below.
1. CHANGES.
Company may change this Policy from time to time in Company’s sole discretion. Accordingly, Company encourages you (“You” or “Your”) to review this Policy periodically. Company shall post an announcement on the Website of any changes to this Policy. The most current version of this Policy shall be linked on the home page of the Website. If You continue to use the Services after Company changes this Policy, then You accept all such changes.
2. INFORMATION COLLECTION, USAGE, AND DISCLOSURE.
2.1 COLLECTION.
(a) Company collects information about You when You visit the Website and when You access or use the Services (collectively the “Collected Information”), including in connection with the following purposes:
(i) To establish and maintain Your registration information;
(ii) To customize the content You see and may access or use as part of the Services;
(iii) To contact You regarding the Services unless You elect not to receive these communications;
(iv) If You voluntarily complete a questionnaire or submit information or data or a request for information; or
(v) If You access or use any of the Services that require registration with Company.
(b) All Collected Information falls into one of two categories: “Identifiable Information” or “Unlimited-Use Information.” Identifiable Information is information that personally identifies You. Unlimited-Use Information is all Collected Information other than Identifiable Information.
(i) Examples of Identifiable Information include Your (1) name, (2) mailing addresses, (3) phone numbers, (4) email addresses, (5) IP address, and (6) mobile phone’s or other mobile device’s (a “Device”) unique identifier assigned by the Device’s service provider.
(ii) Examples of Unlimited-Use Information include Your (1) cookie information, pixel tag information, and other digital behavior, (2) pages requested or visited, (3) frequency of requests or visits, (4) search terms, and (5) public profile and public information associated with any of the Services. In addition, Unlimited-Use Information includes all Identifiable Information that has been de-identified (meaning that no single person can be identified by such de-identified information) and includes all of Your Submissions (as such term is defined and described in the Website General Terms of Use), regardless of the content of such Submissions.
(d) You agree to Company’s collection of all Collected Information (however so collected or requested), including Company’s request for, and collection of, Identifiable Information, and You agree to the association and assimilation of all Collected Information regarding You, subject only to any applicable express limitations in this Policy.
2.2 USAGE AND DISCLOSURE.
(a) Except as described in this Policy, Company shall obtain Your permission before Company (i) uses Identifiable Information in a way that is inconsistent with the purpose or purposes for which it was submitted (as such purpose or purposes are reasonably determined by Company) or (ii) shares Identifiable Information with third parties.
(i) Company may use Identifiable Information (including Your email addresses, phone numbers, and unique Device numbers) to send You promotional materials relating to Company’s products and services and products and services of Company’s affiliates or business partners or otherwise target specific services or offers to You. If You want to stop receiving such promotional materials from Company, then You should follow the applicable unsubscribe or opt-out instructions. Company may also use Identifiable Information to communicate with You about information that You request.
(ii) Company may share Identifiable Information with Company’s parents, subsidiaries, and sister companies.
(iii) Company may share Identifiable Information with third parties that assist in the distribution of funds and/or awards for Company’s programs. These third party service providers are not authorized to retain, share, store, or use Identifiable Information for any purposes other than to provide the services for which such third parties have been hired by Company to provide.
(iv) Company may share Identifiable Information in order to (1) protect or defend the legal rights, property, safety, or security of Company or anyone else, (2) protect against fraud or for risk management purposes, (3) comply with a legal process, legal requirement, judicial proceeding, or court order, (4) investigate a possible crime, such as fraud or identity theft, or (5) as required by law. Company may also share Identifiable Information in connection with the (actual or potential) sale, purchase, merger, reorganization, liquidation, or dissolution of Company.
(b) Company reserves the right to de-identify the Identifiable Information for any and all purposes.
(c) Company is permitted to use and share, without restriction or limitation, all Unlimited-Use Information in Company’s sole discretion. Without limiting the generality of the foregoing sentence, Company reserves the right to use, distribute, edit, display, archive, publish, sublicense, perform, reproduce, make available, transmit, broadcast, sell, repurpose, translate, aggregate, and create derivative works of the Unlimited-Use Information for any and all purposes. In addition, Company may use Unlimited-Use Information to (i) monitor, maintain, and improve the functionality of the Services, making the Services more responsive to the needs of the visitors and users of the Services and to improve Your experience on the Website and with respect to the Services, and (ii) for historical, statistical, scientific, and other purposes.
2.3 SECURITY.
Company takes reasonable precautions to protect Identifiable Information and has put in place certain processes and procedures to prevent unauthorized access of Identifiable Information. Unfortunately, there is always a potential risk in sending information through any channels, and Company cannot guarantee that communications between You and Company, including Identifiable Information, shall be free from unauthorized access by third parties. Company shall not be held responsible (i) for any unauthorized access or illegal or unauthorized use of information, including Identifiable Information, or (ii) if Your information, including Identifiable Information, is accessed through unauthorized or improper use of Your account or login information or due to Your failure to secure your username, password, or customer ID.
3. LINKS TO OTHER SITES.
The Services may contain links to other websites. Those other websites may not have the same privacy policy as Company, and Company is not responsible for the privacy practices of those other websites. When You visit those other websites, You should read their privacy policies. This Policy applies solely to the Services and the information collected by Company through the Services.
4. TRACKING TECHNOLOGIES.
Like many websites, Company may use technologies, such as cookies and pixel tags, that allow Company to make Your visit to the Website easier, more efficient, and more valuable by providing You with a customized experience and recognizing You when You return.
4.1 COOKIES.
A cookie is a small data file transferred by a website to Your computer’s hard drive. The Website sends cookies when (among other occasions) You visit, make a purchase, request or personalize information, or register Yourself for certain Services. A cookie cannot read personal data off your hard disk or read cookie files created by other websites; the only Identifiable Information a cookie can contain is information You supply Yourself. 4.2 PIXEL TAGS.
A pixel tag, also known as a clear GIF or web beacon, is an invisible tag placed on certain pages of the Website but not on Your computer. When You access these pages, pixel tags generate a generic notice to Company of that visit. They usually work in conjunction with cookies, registering when a particular computer visits a particular page. If You turn off cookies, the pixel tag will simply detect an anonymous Website visit.
4.3 CUSTOMIZED LINKS.
Company may also use customized links or other similar technologies to track email links that You click. Company may associate that information with information You have provided in order to provide You more focused communications or product and service related information.
4.4 DISABLING.
If You prefer not to receive cookies, You can set Your browser to warn You before it accepts cookies or refuse the cookie when Your browser alerts You to its presence. You can also refuse all cookies by turning them off in Your browser.
4.5 DNT OPTION (CALIFORNIA CONSUMERS).[/h5] At this time, the Company does not support the Do Not Track browser option.
5. CONSENT.
By using the Website or any Service, You consent to have your personal data, including your Identifiable Information, transferred to, and processed in, the United States pursuant to this Policy. The Services are currently hosted in the United States.
6. INFORMATION EDITS, CORRECTIONS, AND UPDATES.
You have the ability to direct Company to edit, correct, or update information that You have provided at any time. To request account maintenance or changes or to update billing information, send your email request to marketingsupport@authentix.com. You may also indicate that you do not wish to receive messages from Company regarding Company’s services or update Your information relating to such messages at unsubscribe@authentix.com. Company shall update or change Your information, as requested, after Company receives the information necessary to process Your request. You may give notice to the Company by prepaid certified mail, return receipt requested, at the following address: 4355 Excel Parkway, Suite 100, Addison, TX 75001 Attn: LEGAL DEPT, and any such notice shall be effective upon receipt by Company.
CALIFORNIA PRIVACY RIGHTS
California law permits consumers in California to request certain details about how their Collected Information is shared with third parties and, in some cases for direct marketing purposes for those third parties’ and affiliates’. Under California law, the Company must either provide this information or permit California consumers to opt in to, or opt out of, this type of sharing.
The Company may, from time to time, elect to share certain Collected Information collected in the course of the Services with third parties and affiliates for their direct marketing purposes. EU/GDPR PRIVACY RIGHTS
This EU/GDPR privacy rights (this “EU/DGPR”) describes the privacy practices of Authentix Limited and its affiliates (referred to throughout this EU/GDPR Policy as the “Company”) as they relate to the personal data of individuals located within the EU subject to and including the Data Protection Act 1998 (“DPA”) and EC Directive 95/46/EC (the “DP Directive”) (up to and including 24 May 2018), the Data Protection Act 2018 (subject to royal assent), and the GDPR (on and from 25 May 2018); and (b) any code of practice or guidance published by the ICO and/or European Data Protection Board from time to time. This EU/GDPR Policy applies to this Authentix® website (the “Website”) and all services offered by or through the Website (the Website and such services are collectively the “Services” to the extent that they relate to the personal data of individuals located in the European Union.

Company may change this EU/GDPR Policy from time to time in Company’s sole discretion. Accordingly, Company encourages you (“You” or “Your”) to review this EU/GDPR Policy periodically. 2. INFORMATION COLLECTION, USAGE, AND DISCLOSURE.
Company collects and processes certain information that may personally identify You (“Identifiable Information”).
2.1 COLLECTION OF IDENTIFIABLE INFORMATION
Company collects and processes the following Identifiable Information:
(a) Identifiable Information You give Company. This is information about You that You give Company by filling in forms on the Website or by corresponding with Company by phone, e-mail or otherwise and includes information You provide when You register to use the Website or sign up to use the Services. The information you give Company may include Your name, address, e-mail address, user name and password, phone number and details of any comments You provide to us. Other information You give Company may include feedback regarding the Services or the Website and responses to surveys and/or market research (although You do not have to respond to such surveys or requests). Company may also collect and process records of any correspondence and communications with Company and telephone calls may also be recorded.
(b) Identifiable Information Company collects about You. With regard to each of Your visits to the Website, Company may automatically collect the following information:

(ii) details of Your visits to the Website and Your preferences and habits when using the Services; Company will use this information to create a profile of You for the purpose of enhancing Your customer experience with Company;
(iii) information about Your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from the Website (including date and time), the Services You viewed or searched for, Your conduct via the Website and (where relevant) details of the fulfilment of any of Your orders, and any other site activity, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page and any phone number used to call Company.]
2.2 USAGE AND DISCLOSURE.
(a) Identifiable Information You give Company. Company will use this information:
• To carry out Company’s obligations arising from any agreements entered into between You and Company and to provide You with the information, products and services that You request from Company;
• To establish and maintain Your registration information;
• To notify You about changes to any of the Services;
• To provide You with information about services Company offers that are similar to those that You have already purchased or enquired about, as further detailed in the ‘Marketing’ section below.
• If You voluntarily complete a questionnaire or submit information or data or a request for information; and
• If You access or use any of the Services that require registration with Company.
(b) Identifiable Information Company collects about You. Company will use this information:
• To administer the Website and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;

Company relies on the following conditions to process Your Identifiable Information:
• To allow Company to perform its contract with You: When You purchase goods and Services from Company, a contract between You and Company will have been entered into. In order for Company to fulfil Company’s obligations under such contract, Company will need to collect and process Your Identifiable Information.
• To allow Company to exercise its legitimate interests as a data controller: Company relies on its legitimate interests as a data controller to process the Identifiable Information that You provide to Company on contact / feedback forms and to process the Identifiable Information that Company collects from You when You use the Website. It is in Company’s legitimate interests as a business to process the above information in order administer the Website, to ensure that content from the Website is presented to You effectively and securely, and to run promotional features.
2.4 RETENTION OF YOUR INFORMATION.
Company will retain Your Identifiable Information for the period necessary to fulfil the purposes for which the information was collected. After that, Company will delete it.
The retention period may vary depending on the purposes for which the information was collected. Where a specific legal or regulatory requirement applies to Your Identifiable Information, Company will retain it for the period of time specified in such legal or regulatory requirement. In the absence of a specific legal or regulatory requirement, Company will retain Your information for six years following the event to which it relates (e.g. the specific sale, enquiry, etc). Company may be required to extend the retention period if the information is required due a complaint or because it is required for litigation. Please also note that Company is sometimes legally obliged to retain the information, for example, for tax and accounting purposes.
2.5 DISCLOSURE OF YOUR INFORMATION.
Company will not share Your Identifiable Information with third parties, save as follows:
• with Company’s parents, subsidiaries, and sister companies for the purposes of marketing and only where You have provided Your consent, as described below;
• with our business partners, product and services suppliers and sub-contractors;
• with third parties that assist in the distribution of funds and/or awards for Company’s programs. These third party service providers are not authorized to retain, share, store, or use Identifiable Information for any purposes other than to provide the services for which such third parties have been hired by Company to provide; and
• with third party analytics suppliers that work with Company for the purposes of producing aggregate statistics about customers, sales, traffic patterns and related site information – Company uses this information for the purposes detailed above and the third party suppliers use this information to inform their own analytics products and services.
Company may also share Identifiable Information with law enforcement / regulatory authorities, other government officials and / or Company’s legal and professional advisors in order to (1) protect or defend the legal rights, property, safety, or security of Company or anyone else, (2) protect against fraud or for risk management purposes, (3) comply with a legal process, legal requirement, judicial proceeding, or court order, (4) investigate a possible crime, such as fraud or identity theft, or (5) as required by law.
Company may also share Identifiable Information in connection with the (actual or potential) sale, purchase, merger, reorganization, liquidation, or dissolution of Company.
2.6 SECURITY.

2.7 STORAGE OF YOUR INFORMATION.
The data that Company collects from You may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). It may also be processed by staff operating outside the EEA (for example, in the United States), who work for Company or for one of Company’s suppliers.
When we send Your data to a destination outside the EEA we will make sure suitable safeguards are in place, in accordance with European data protection requirements, to protect the data. In all cases these safeguards will be one of the following:
• Sending the data to a country that’s been approved by the European authorities as having a suitably high standard of data protection law.
• Putting in place a contract with the recipient containing terms approved by the European authorities as providing a suitable level of protection.

2.8 MARKETING
Company may use Identifiable Information (including Your email addresses, phone numbers, and unique Device numbers to send You promotional materials relating to Company’s products and services that are similar to those that you have already purchased or enquired about. If You have not previously purchased or enquired about such products or services, we will not send You promotional materials without first obtaining Your consent to do so.
If You want to stop receiving such promotional materials from Company, then You should follow the applicable unsubscribe or opt-out instructions.
Company’s affiliates or business partners may also use Your personal information to contact You about other goods and services, provided that You have given Your consent.

4. YOUR RIGHTS
You have certain rights in relation to Your Identifiable Information that is processed by Company. These rights are listed below. These rights are not absolute and apply subject to certain conditions, as set out in applicable data protection laws. Your rights may include:

• the right to require Company to rectify any inaccurate personal data held by Company about You;
